DRT & SARFAESI
Debt recovery and SARFAESI enforcement for banks, NBFCs, and borrowers.
Debt recovery proceedings before the Debt Recovery Tribunals and enforcement under the SARFAESI Act are the primary tools available to secured creditors in India. We appear for banks, NBFCs, and asset reconstruction companies on one side and for borrowers and guarantors on the other.
Under the SARFAESI Act, 2002, we advise secured creditors on the steps for taking symbolic and physical possession of secured assets, on the conduct of auctions, and on the enforcement of security interests over movable and immovable property. For borrowers we challenge possession notices, auction proceedings, and the valuation of assets, and we file applications under Section 17 before the Debt Recovery Tribunal to set aside SARFAESI action.
Before the Debt Recovery Tribunal we file and defend original applications for recovery of debt, and we appear in proceedings for attachment and sale of property. We also act in appeals before the Debt Recovery Appellate Tribunal and carry questions of law to the High Court of Andhra Pradesh and the Supreme Court of India. NPA resolution, one time settlement negotiations, and securitisation disputes are also part of our practice in this area.
